The legislation concerning IR35 (technically known as the Intermediaries Legislation) is part of the UK’s anti-avoidance tax legislation. It was originally Introduced in 1999, becoming law as part of Finance Act 2000. The legislation is designed to stop workers from supplying work through intermediaries (usually in the form of limited companies known as personal service companies (“PSCs”).

With effect from April 2020, the responsibility for the tax status determination will shift to the end client. The NCIs will therefore be responsible for determining the IR35 status of people who work for them, but do not have employment status.

As IR35 Project Support Officer, you will investigate the current status of contractors and their engagement with us. You will record and manage this information efficiently and accurately, ensuring that actual working practices mirror the written terms.

A confident and professional individual, you will have strong project management skills and the ability to develop excellent working relationships, liaising with colleagues in various departments including HR, Payroll, Procurement and Legal.

With knowledge of IR35 and relevant legislation, you will have both administrative and data management experience and the ability to design new systems and processes to capture evidence and ensure compliance.

This is a full time post (35 hours per week) however part time hours will be considered.

This is a fixed term contract/secondment expected to last for 3 months

The Role

  • Request copies of contracts and check with the line manager and the end client directly, to ensure that the actual working practices mirror the written terms
  • Conduct a full IR35 contract review to provide an assessment of both the contract and working practices
  • Investigate compliance and ensure contractors provide the relevant evidence
  • Record relevant data to demonstrate that ‘reasonable steps’ have been taken to ascertain the employment and tax status of all contractors.
  • Liaise with colleagues in various departments including HR, Finance, Payroll, Procurement and Legal to assist with gathering information and carrying out necessary tests
  • Design systems and processes to capture evidence and ensure compliance on an ongoing basis
  • Communicate tax status assessments to contractors and handle any subsequent appeals
  • Ensure data systems are updated with findings for all contractors

Essential skills will be :

  • Administration : experience, accuracy, attention to detail
  • Systems : MSOffice, Excel, Word etc and Resourcelink (ideally) or some knowledge of SAP/payroll systems
  • Knowledge of IR35 ideally or some knowledge of tax treatment of individuals
  • Project management skills
  • Effective communication skills and the ability to engage confidently with people at all levels
  • Accurate and engaging written communication and letter writing skills
  • Focus, resilience and the ability to work to deadlines
